Refund & Early Termination Policy1. Early Termination:
Either party may terminate this Agreement prior to the agreed-upon Termination Date, with or without cause, by providing written notice between 33 to 90 days in advance ("Early Termination"). In the event of Early Termination:The Contractor shall receive a pro-rated payment for services rendered up to the termination date.A 20% processing fee will be deducted from any refund issued,Other fees may apply, including but not limited to, a 50% deduction from the deposit due to the loss of business caused by the date being reserved and unavailable to other clients.The remaining balance, if applicable, will be issued as store credit.2. Assignment and Additional Services:
This Agreement does not establish an ongoing relationship of indefinite duration. The Recipient may not assign additional services to the Contractor outside of what is explicitly stated in this Agreement, unless both parties mutually agree in writing to any modifications or additions.3. Payment for Services:
The Recipient agrees to compensate the Contractor according to the terms of this Agreement. No additional fees or expenses will be paid unless pre-approved in writing by an authorized executive of the Recipient.4. Cancellations Due to Unforeseen Circumstances:
In the event of cancellation due to circumstances beyond control (e.g., inclement weather), the deposit is non-refundable, unless the Contractor voluntarily agrees to issue a refund. If a refund is issued, it will be processed within 90 days, subject to a 20% processing fee. Other fees may apply based on incurred costs.5. Breach of Agreement:
A breach of this Agreement includes but is not limited to:Disputing a transaction without first contacting the company in writing (via message or email as outlined in the Agreement).Allowing other photographers or similar service providers at the event without prior written consent.This clause is intended to preserve the quality and consistency of services. Unauthorized third parties may disrupt workflow, reduce quality, and interfere with contracted deliverables.

VOLUNTARY / AT-WILL CANCELLATION AFTER REVIEW OF WORKPLEASE REVIEW BEFORE BOOKINGBefore booking photography or videography services, clients are provided with an opportunity to review examples of our previous work, including full event galleries, edited photographs, RAW/unedited photographs where available, video samples, and examples of our different shooting, editing, lighting, color-grading, and creative styles.These examples may be provided through Google Drive, online galleries, our website, social media, or other portfolio materials.The purpose of providing this material before booking and payment is to allow every client to fully understand the quality, artistic style, editing process, and type of final work they can reasonably expect from us.Photography and videography are artistic services. Every event is different, and results may vary depending on lighting, location, weather, venue restrictions, available time, subject cooperation, event conditions, and other circumstances outside of the photographer or videographer's control.CLIENT ACCEPTANCE OF QUALITY & STYLEBy completing a booking, making a deposit/payment, or signing an agreement, the client acknowledges that they have had a reasonable opportunity to review our previous work and determine whether our quality and artistic style are appropriate for their event.The client therefore acknowledges that a later change of preference, change of mind, scheduling change, financial situation, event cancellation, selection of another photographer/videographer, or other voluntary decision to cancel does not, by itself, establish that our services or quality of work were deficient.Unless there has been an actual material failure by us to provide services required under the applicable agreement, a cancellation initiated by the client will be treated as a voluntary / at-will client cancellation and will be subject to the applicable cancellation and refund terms.DISCOUNTED PRICINGClients may also receive pricing that is substantially below the rates commonly charged for comparable professional photography and videography services.Where expressly advertised or communicated for a particular booking, our pricing may be approximately 50% below the pricing we have identified for comparable artisan and high-demand photographers and/or videographers offering similar levels of service, experience, production, and quality.Discounted or promotional pricing does not reduce the client's responsibility to review our portfolio, policies, service descriptions, deliverables, turnaround times, and artistic style before booking.Discounted pricing also does not create an entitlement to a refund outside of the refund and cancellation terms agreed to at the time of booking.ARTISTIC DIFFERENCES ARE NOT AUTOMATIC GROUNDS FOR REFUNDA client's later preference for a different editing style, color treatment, composition, pose, creative approach, photographic style, cinematic style, or other subjective artistic preference does not automatically constitute defective service or grounds for a refund when the photographer/videographer's general style and previous examples were made available for review prior to booking.REFUNDS & CANCELLATIONSAny deposit, retainer, booking fee, refund, cancellation charge, rescheduling fee, or other payment obligation will be governed by the specific Refund & Cancellation Policy and/or service agreement applicable to the client's booking.Once an event date and time have been reserved, we may decline other clients for that date. For this reason, certain booking fees, retainers, deposits, or payments may be non-refundable as specifically disclosed at the time of booking.REVIEWS & PUBLIC STATEMENTSNothing in this policy prevents a client from providing an honest review, expressing a genuine opinion, reporting an actual experience, or exercising any right protected by applicable law.However, clients are expected not to knowingly publish or distribute materially false statements of fact, fabricated allegations, manipulated information presented as factual, or other statements that may constitute defamation, libel, slander, fraud, or another unlawful falsehood.FINAL ACKNOWLEDGMENTBy booking our photography or videography services, the client acknowledges that examples of our quality and artistic style were made reasonably available before booking and that the client had the opportunity to review those examples before deciding to proceed.**Accordingly, a voluntary cancellation after booking shall not, by itself, be interpreted as evidence that the photographer/videographer provided poor-quality work or misrepresented the quality or artistic style of the services offered.Clients who are uncertain about our artistic style, quality, deliverables, or policies are encouraged to review the provided portfolio materials and request clarification before booking, signing an agreement, or submitting payment.

CALIFORNIA PHOTOGRAPHY STYLE ACKNOWLEDGMENT, CLIENT CANCELLATION & NON-REFUNDABLE RESERVATION RETAINERPrior to entering into this Agreement, Client acknowledges that Photographer has provided Client with a reasonable opportunity to review examples of Photographer’s prior work, including photography style, composition, posing, lighting, color treatment, editing style, and overall creative format. By signing this Agreement and paying the Reservation Retainer, Client acknowledges and accepts Photographer’s demonstrated artistic style and creative approach.If Client subsequently changes their personal preference, taste, expectations, or opinion regarding a photography or editing style that was reasonably disclosed or demonstrated prior to execution of this Agreement, such change in preference shall not, by itself, constitute defective performance, failure to perform, or breach of this Agreement by Photographer.If Client elects to terminate or cancel the Agreement solely because Client is no longer satisfied with or has changed their preference regarding Photographer’s previously disclosed and accepted style or creative format, the cancellation shall constitute a Client-Initiated Cancellation and Breach of the Agreement, subject to the cancellation provisions contained herein.NON-REFUNDABLE RESERVATION RETAINERClient acknowledges that the initial payment is a Reservation Retainer paid in consideration for Photographer accepting the booking and reserving the agreed event date and/or time exclusively for Client.Upon acceptance of the Reservation Retainer, Photographer may decline, become unavailable for, or otherwise lose the opportunity to accept other photography assignments for the reserved date and time. Photographer may also incur administrative, scheduling, planning, consultation, preparation, and other business expenses associated with Client's reservation.Because the actual financial loss resulting from a Client cancellation—including lost booking opportunities—may be impracticable or extremely difficult to accurately determine at the time this Agreement is entered into, the parties agree that the Reservation Retainer represents a reasonable estimate of the damages Photographer may sustain as a result of Client's cancellation and reservation of Photographer's availability.Accordingly, to the fullest extent permitted by California law, the Reservation Retainer is NON-REFUNDABLE following a Client-Initiated Cancellation, including a cancellation resulting solely from Client's subsequent change in preference concerning Photographer's previously disclosed and accepted photography or editing style.The Reservation Retainer is intended to reasonably compensate Photographer for reserving the date, lost booking opportunities, administrative and preparatory obligations, and other reasonably anticipated losses associated with the cancellation. It is not intended to operate as a penalty or punishment against Client.Nothing in this provision eliminates any rights or remedies that cannot lawfully be waived under applicable California law.

Política de Reembolsos y Terminación Anticipada1. Terminación Anticipada:
Cualquiera de las partes podrá dar por terminado este Acuerdo antes de la Fecha de Terminación acordada, con o sin causa, mediante notificación escrita con un plazo de 33 a 90 días de anticipación ("Terminación Anticipada"). En caso de Terminación Anticipada:El Contratista recibirá un pago prorrateado por los servicios prestados hasta la fecha de terminación.Se deducirá una tarifa de procesamiento del 20% de cualquier reembolso emitido.Pueden aplicarse otras tarifas, incluyendo, pero no limitándose a, una deducción del 50% del depósito debido a la pérdida de oportunidades comerciales ocasionada por la reserva de la fecha.El saldo restante, si aplica, se emitirá como crédito en la tienda.2. Cesión y Servicios Adicionales:
Este Acuerdo no establece una relación continua de duración indefinida. El Cliente no podrá asignar servicios adicionales al Contratista fuera de lo expresamente establecido, a menos que ambas partes lo acuerden por escrito.3. Pago por los Servicios:
El Cliente acuerda compensar al Contratista según los términos establecidos en este Acuerdo. No se pagarán tarifas o gastos adicionales a menos que hayan sido aprobados por escrito por un representante autorizado del Cliente.4. Cancelaciones por Circunstancias Inesperadas:
En caso de cancelación por circunstancias fuera de control (por ejemplo, mal clima), el depósito no será reembolsado, a menos que el Contratista decida hacerlo voluntariamente. Si se otorga un reembolso, se procesará dentro de un plazo de 90 días, sujeto a una tarifa de procesamiento del 20%. Pueden aplicarse otras tarifas según los costos incurridos.5. Incumplimiento del Acuerdo:
Se considerará un incumplimiento de este Acuerdo, entre otros:Disputar una transacción sin antes contactar a la empresa por escrito (vía mensaje o correo electrónico, según lo indicado en el Acuerdo).Permitir la presencia de otros fotógrafos u otros proveedores de servicios similares en el evento sin el consentimiento previo por escrito.Esta cláusula tiene como objetivo preservar la calidad y el flujo del trabajo. La intervención de terceros no autorizados puede generar interrupciones y afectar el cumplimiento de los servicios contratados.
